1. Scope
These general terms and conditions apply to all contracts concluded between a customer and Grässlin Zeitschalttechnik GmbH for services offered at the online shop at https://graesslin.de/shop/. A customer may be any consumer (in accordance with Section 13 of the German Civil Code – BGB), meaning every natural person who enters into a legal transaction for purposes that predominantly are outside their trade, business or profession.

2. Conclusion of a contract
By pressing the “Place order” button, the customer submits a binding order, which represents a contractual offer vis-à-vis Grässlin Zeitschalttechnik GmbH. Once this order has been sent electronically, Grässlin Zeitschalttechnik GmbH sends an e-mail to the customer confirming that the order has been received and describing the details of the order. This order confirmation does not constitute acceptance of the contractual offer in a legal sense; rather, it simply informs the customer that their order has been received by Grässlin Zeitschalttechnik GmbH. The contract between the customer and Grässlin Zeitschalttechnik GmbH is established based on the purchase of goods and the shipping of the ordered goods by Grässlin Zeitschalttechnik GmbH. Grässlin Zeitschalttechnik GmbH reserves the right not to deliver the ordered goods and/or render the ordered service, and to recompense the customer for any payment they may already have made, if the delivery and/or service cannot be offered or is temporarily unavailable despite a contract having been concluded.

3. Transfer of the goods
Ordered goods are transferred when they are delivered to the delivery address specified by the customer. Any shipping costs that may be incurred are communicated to the customer on the order page and agreed with the customer prior to the conclusion of the contract. In the event that deliveries are sent abroad, the customer is responsible for paying any additional taxes and customs charges that may be incurred.

4. Pricing
All indicated prices include statutory value added tax. Calculation is in Euro only. The prices specified on the day the order is placed in the online shop apply exclusively in each case.

6. Liability
a) The customer is entitled to assert statutory warranty claims subject to paragraphs b) to e) below.
b) Claims for damages by the customer are excluded. Exceptions to this are claims for damages by the customer which arise due to loss of life, limb or health or due to the violation of material contractual obligations as well as liability for other damage which is based on an intentional or grossly negligent violation of obligations by Grässlin Zeitschalttechnik GmbH, its legal representatives or vicarious agents. Material contractual obligations are obligations that enable the proper performance of the contract in the first place and on the performance of which the customer may regularly rely.
c) In the event that material contractual obligations are violated, Grässlin Zeitschalttechnik GmbH shall only be liable for foreseeable damage that is typical for the contract if this was caused by ordinary negligence, unless the claims for damages asserted by the customer arise from a loss of life, limb or health.
d) The restrictions of paragraphs b) and c) also apply in favour of the legal representatives and vicarious agents of Grässlin Zeitschalttechnik GmbH if claims are asserted against these directly.
e) The provisions of the German Product Liability Act remain unaffected, as will any claims arising from a guarantee given by Grässlin Zeitschalttechnik GmbH or a third party relating to features of the purchased service.

7. Payment options and terms of payment, retention of title
a) Grässlin Zeitschalttechnik GmbH offers the customer exclusively per advance payment the following payment options: credit card, PayPal.
B) The invoice for the order will be delivered to the customer via e-mail.
c) Goods sent to the customer remain the property of Grässlin Zeitschalttechnik GmbH until they have been paid for in full.

8. Cancellation of goods
In the case of contracts for the supply of goods, the customer has the following cancellation right:

You have the right to cancel this contract within fourteen days without stating your reasons for doing so. The cancellation period is fourteen days from the date
– on which you or a third party named by you, who is not a carrier, have/has taken possession of the goods, if you have ordered one item or several goods as part of a single order and the item is delivered / the goods are delivered as one consignment
– on which you or a third party named by you, who is not a carrier, have/has taken possession of the last of the goods, if you have ordered several goods as part of a single order and the goods are delivered separately;
– on which you or a third party named by you, who is not a carrier, have/has taken possession of the last partial shipment or the last part, if you have ordered an item that is delivered in several partial shipments or parts. If more than one of the aforementioned options applies, the cancellation period only commences when you or a third party named by you, who is not a carrier, have/has taken possession of the last of the goods, the last partial shipment or the last part.

To exercise your cancellation right, you must inform us (Grässlin Zeitschalttechnik GmbH, Leopoldstraße 1, 78112 St. Georgen, Germany, tel. +49 (0)7724/933-0, fax +49 (0)7724/933-240, shop@graesslin.de) of your decision to cancel this contract by submitting a clear statement to this effect (e.g. a letter sent by post or an e-mail). You may use the enclosed model cancellation form for this purpose, but are not obliged to do so. To meet the deadline for the cancellation period, the notification of your decision to exercise the cancellation right must merely be sent before the end of the cancellation period.

To exercise your cancellation right, you must inform us (Grässlin Zeitschalttechnik GmbH, Leopoldstraße 1, 78112 St. Georgen, Germany, tel. +49 (0)7724/933-0, fax +49 (0)7724/933-240, shop@graesslin.de) of your decision to cancel this contract by submitting a clear statement to this effect (e.g. a letter sent by post or an e-mail). You may use the enclosed model cancellation form for this purpose, but are not obliged to do so. To meet the deadline for the cancellation period, the notification of your decision to exercise the cancellation right must merely be sent before the end of the cancellation period.

Consequences of cancellation
If you cancel this contract, we have to reimburse you with all payments that we have received from you, including the delivery costs (with the exception of any additional costs that have resulted from your having selected a different type of delivery from the cheapest standard delivery option offered by us), without delay and certainly no later than within fourteen days of our having received the notification of your decision to cancel this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless otherwise expressly agreed with you; under no circumstances will you be charged any fees as a result of this reimbursement. We can refuse reimbursement until the goods have been returned to us or until you have provided proof that you have returned the goods to us, whichever is soonest. You must send back or transfer the goods to us without delay and certainly no later than within fourteen days of our having received the notification of your decision to cancel this contract. The deadline is met if you have sent the goods before the fourteen-day period has passed.

You will only have to pay for any loss of value to the goods if this loss of value is due to the unnecessary handling of the goods when their condition, features and function were inspected.

Exclusion / premature expiry of the cancellation right
The cancellation right does not exist for contracts for the supply of goods that are not prefabricated and the production of which is governed by an individual choice of or decision by the consumer, or that are clearly tailored to personal needs of the consumer. The cancellation right expires prematurely for contracts for the supply of sealed computer software, if it was unsealed after delivery.

10. Data privacy declaration
The customer is provided with detailed information on the data privacy content regarding the type, scope, place and purpose of the collection, processing and use of the personal data required to fulfil orders by Grässlin Zeitschalttechnik GmbH via this link to the data privacy statement (https://graesslin.de/datenschutzerklaerung/). The customer expressly consents to this collection, processing and use of personal data. They may withdraw their consent at any time with future effect.

11. Validity of these General Terms and Conditions
Should individual provisions of these General Terms and Conditions be or become invalid, this shall not affect the validity of the remaining provisions. Furthermore, the statutory provisions shall apply.

12. Online dispute resolution and consumer arbitration
The European Commission provides a platform for online dispute resolution (ODR) which can be accessed at https://ec.europa.eu/consumers/odr/. Grässlin Zeitschalttechnik GmbH is neither willing nor obligated to participate in a dispute resolution before a consumer arbitration authority.
